The penalties you can receive if convicted of a DUI are harsh, to say the least. This is due partly to the state legislature's determination to crack down on drunk driving in recent years. The severity is also intended to prevent repeat offenses by punishing the driver so that they are not likely to drive drunk again. Driving under the influence of alcohol or drugs (DUI or DUID) is classified as a misdemeanor offense in Colorado in the following circumstances:
- This is your first DUI offense - you have no previous record of having been arrested for, or charged with, driving under the influence.
- You are charged with a second DUI offense.
- You are charged with a third DUI offense.
- You were not involved in an accident that resulted in injuries or death to another person.
If you have three prior convictions for DUI, a fourth (or subsequent) DUI is a Class 4 Felony under Colorado law.
